SMS Consent
How dealerships using the Apex BDC platform capture consent to text consumers, in line with TCPA guidelines.
Who sends the messages
Apex BDC is a communications platform operated by AutoCity LLC dba Apex BDC. Our address is 585 Chestnut Street, Union, NJ 07083. Automotive dealerships use the platform to respond to their leads and follow up with their customers.
Text messages are sent by the participating dealership using its Apex BDC workspace. Each message identifies the sending dealership by name (for example, "CarTopia LLC"). The Apex BDC platform provides the software and the toll-free number.
The current participating dealership is CarTopia LLC, an independent used-car dealership at 897 Route 22 West, North Plainfield, NJ 07060, licensed in New Jersey and reachable at (908) 669-9100 or mycartopia.com.
How consumers opt in
Consumers give the dealership prior express consent to receive text messages through one of three paths. Each path is captured in the dealership's CRM, VinSolutions, with the source, timestamp, and consent record retained for the life of the customer relationship.
1. Third-party lead marketplaces and chat providers
The dealership receives lead submissions from third-party automotive marketplaces and chat lead providers that the consumer chose to use. Sources include, but are not limited to, Cars.com, CarGurus, Carfax, Kelley Blue Book, Capital One Auto Navigator, AutoTrader, and third-party chat lead providers that deliver leads by email.
Each of these marketplace and chat forms includes its own SMS and contact disclosure that the consumer accepts when submitting the lead. The consumer's phone number, the originating lead source, and the timestamp flow into the dealership's CRM (VinSolutions), which retains the consent event as part of the lead record.
2. Direct inbound phone calls and in-store visits
When a consumer calls the dealership directly or visits the showroom, the dealership representative asks whether the consumer would like to receive text updates about their vehicle inquiry, appointment, or service. The representative records the verbal consent, the caller ID or in-store record, and the timestamp in VinSolutions.
Verbal consent script used by the dealership:
"This is [representative name] calling from CarTopia. Would you like to receive text message updates from us about your inquiry? Message frequency varies, message and data rates may apply, reply STOP to unsubscribe, and consent is not a condition of purchase."
3. Dealership website and in-store forms
Consumers who complete a lead form on the dealership's website (such as a car-finder or contact form) or a paper form in the showroom provide their phone number as part of that inquiry. Where applicable, an unchecked SMS consent box acknowledges the dealership's messaging terms. The completed form is retained by the dealership and the consent event is logged in VinSolutions.
What the consumer receives
After opting in, the consumer may receive text messages from the dealership related to their inquiry, including:
- Appointment confirmations and reminders
- Answers to questions the consumer asked about a specific vehicle, price, or availability
- Follow-up on a test drive, trade valuation, or financing conversation
- Service department appointment reminders
The dealership does not send promotional blasts, offers unrelated to the consumer's inquiry, or messages on behalf of any third party. Consumer phone numbers are not shared, sold, or used for affiliate marketing.
Opting out and getting help
Consumers can opt out of text messages at any time by replying STOP to any message. They will receive one confirmation message and no further messages. Opt-outs are honored across the dealership's Apex BDC workspace within seconds.

TCPA and carrier compliance
- Consent to receive text messages is not a condition of any purchase, financing, service, or other transaction.
- Message frequency varies based on the consumer's active inquiry. Typical volume is fewer than 10 messages per consumer per month.
- Message and data rates may apply from the consumer's wireless carrier.
- Outbound messages are restricted to local calling hours per the consumer's time zone, in line with TCPA guidance.
- Consumer phone numbers and messaging data are not sold, rented, or shared with third parties or affiliates for marketing purposes.
- Opt-out requests are honored immediately across all dealership channels using the Apex BDC workspace.
