Terms of Service

By creating a workspace or using Apex BDC (operated by AutoCity LLC dba Apex BDC) you agree to these terms.

Plans are billed monthly or annually per the order form. Fees are non-refundable except as required by law.

Do not use Apex BDC to send unlawful messages, harass consumers, or violate TCPA / CAN-SPAM. You are responsible for the messages your workspace sends.

Workspaces on Apex BDC that send SMS or voice communications must comply with the TCPA, CAN-SPAM, and all applicable federal and state messaging laws. Each dealership is responsible for capturing and retaining prior express consent from every consumer it messages, honoring opt-out requests immediately, and identifying itself by name in every message. You own your workspace data. We process it as described in the Privacy Policy and the Data Processing Addendum.

We target high availability but do not guarantee uninterrupted service. Scheduled maintenance is communicated in advance where possible.

Either party may terminate per the order form. On termination we provide an export window before deletion.

To the maximum extent permitted by law, AutoCity LLC dba Apex BDC's aggregate liability for Apex BDC is limited to the fees paid in the prior twelve months.
